- Posted an emergency rule from the Indiana Board of Pharmacy. The rule temporarily amends 856 IAC 2-2-6 to add drug compounds to Schedule V. Statutory authority: IC 25-26-13-4.1. Effective 30 days after filing with the Publisher. The rule was filed on November 21, 2018 and became effective December 21, 2018. - Paper settlements documents will no longer be accepted by the Board. Those sent in or dropped off will be destroyed and the parties informed by phone or e-mail to submit the Agreement and Order as a PDF according to the Checklist and Procedure documents found here(and Attached). Documents will not be marked Received until processed through the electronic system. Please know the Board will continue to improve this process as comments are received and notice will always be given through this format and notices on the website.

- Posted notice of adoption of emergency rules regarding the operation of remote dispensing facilities. The Indiana Board of Pharmacy temporarily amends 856 IAC 1 to add standards and requirements for the operation of remote dispensing facilities. Statutory authority: IC 25-26-13.5-18.
- The Pharmacy Board also posted notice to temporarily amend 856 IAC 2-2-2 to add synthetic drug compounds to Schedule I. Statutory authority: IC 25-26-13-4.1.

- On Tuesday, August 21, 2018 at 2:30 Eastern, the Indiana Workers’ Compensation Board offered a Claims Release 3.1 EDI for First Report of Injury (FROI) and Subsequent Report of Injury (SROI) Webinar Information Session.

- The Board has posted the EDI Claims Release 3.1 Requirement Tables, Version 1.0. The Requirement Tables are immediately available for download on the EDI Requirements Page of INWCB EDI Claims Website: https://INWCBEDI.info/requirements . The Event Table, Element Requirement Table and Edit Matrix each contain a change log worksheet that will identify any changes made to that specific table after these initial requirements are published.
- Important EDI Claims R3.1 Information: Trading Partner Profile Registration for EDI Claims; Release 3.1 is Now Available!! Indiana’s EDI Trading Partner Registration can be found online at https://inwcbedi.info/register. Detailed registration instructions on how to complete the online form is available for download here. Trading Partners are expected to complete the Indiana EDI Claims Release 3.1. Registration no later than November 7, 2018. - Posted notice for self-insurance application guidelines for 2018. Please keep in mind that it is extremely important that you answer all of the questions on the application. All of the attachments and additional information requested in item 7 must be provided. Incomplete applications cannot be processed and will not be approved. The completed application should be returned to our office no later than July 31, 2018. Late and incomplete applications are subject to a late fee as described below. Please note the following regarding the supplemental forms attached to the application. Form SI-4 (Indemnity Agreement by the Parent Corporation for Wholly Owned or Majority Subsidiary) should be completed if you are adding or revising any subsidiaries. A valid surety bond or other approved security must be on file with the Board at all times. If we already have a bond (on the revised 2003 form) or other approved security, it is not necessary to include another with this application.; A current SI-3 (Certificate of Excess Insurance) must be on file with the Board at all times. If we already have a current SI-3 on file for your company, it is not necessary to include another with this application. If you are not specifically involved in the trucking industry, it is not necessary to complete the Form SI-5 (Truckers Supplemental Application). Pursuant to IC 22-3-5-1(b), renewal applications must be accompanied by a payment of $250.00. The agency will not accept cash payments. Checks or money orders must be payable to "Worker’s Compensation Supplemental Administrative Fund." Incomplete applications and renewal applications received after July 31, 2017, will be charged an additional $250.00 late fee. Deadline extensions shall be granted only under extraordinary circumstances and at the Board’s discretion. - Posted notice of a new protocol for submitting settlement agreements to the Board will go into effect within the next 30-45 days. A similar notice will be issued at that time. The Board is working with the Indiana Office of Technology to perfect the procedure and anticipates there may be slight changes; however, the Checklist should be followed whenever possible as of the date of this notice. REGULATORY ACTIVITY:
- Public Law 204, previously SB290, will go into effect on July 1st, 2018. This bill imposes new time frames for completing certain tasks and changes the way penalties are assessed for failing to maintain workers’ compensation insurance coverage on an employer’s workers. It also extends the renewal period for Second Injury Fund wage replacement benefits from 150 weeks to three years.
- Public Law 206, previously SB369, adopts a formulary for certain drugs often prescribed for injured workers. FAQs and guidance will be forthcoming before Appendix A to the Official Disability Guidelines; informally referred to as the “ODG,” will go into effect on January 1, 2019.
- Indiana Workers' Compensation Community, Workers’ Compensation Board of Indiana (INWCB) will be implementing electronic reporting of workers’ compensation first reports of injury (FROI) and subsequent reports of injury (SROI). Electronic reporting will be required for all trading partners: insurers, self-insured employers, and claim administrators. Mandatory implementation is planned for January 1, 2019. Please note that Indiana already has FROI 1.0 reporting in place.
- Electronic reporting will be via Electronic Data Interchange (EDI) transactions using the Claims 3.1 reporting standards adopted by the International Association of Industrial Accident Boards and Commissions (IAIABC). Additional information on the IAIABC EDI transactions for FROI and SROI can be found online at the IAIABC website, http://www.iaiabc.org.
Indiana has contracted with ISO's Workers’ Compensation Solutions division, to manage its FROI and SROI EDI reporting. ISO will be administering registration of trading partners, testing, data collection and submission of EDI data to the State. INWCB will provide an enhanced EDI Website that will be available early June 2018. This website address will be provided at that time and will contain the following.
- Trading Partner Electronic Profiles Registration and Instructions to be completed by all Trading Partners
- Trading Partner Training Schedule
- Trading Partner Testing Documentation/Plan. (Note: For Trading Partners that will utilize a Vendor, the Vendor will perform the testing on your behalf)

- The Board will be implementing a new protocol for submitting “C” claim settlement documents in the near future. The legal environment surrounding Indiana worker’s compensation cases is changing. We are seeing many more settlements. Fewer cases are resolved through hearings. Therefore, once we have the internal processes in place, documents submitted for approval in “C” claims will go to the respective Single Hearing Members. Please disregard any documentation you may have seen, as the Board has not finalized anything in this regard.
